The website has the main purpose to guide users to the best travel deals, ideas and reviews, facilitating the interaction between them using an interactive platform. Also, Tripelonia offers its users a platform for the exchange of travel related experiences and information about accommodation, attractions, travel destinations and all kinds of services related to travelling.

Please read the following terms and conditions ("Terms and Conditions") carefully. By using the Services you are agreeing to be bound by these Terms and Conditions which apply whether you are a registered user of the Services or a non-registered user just browsing (collectively "Users").

These Terms and Conditions, as may be amended from time to time, apply to all our services directly or indirectly made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our website or any of our applications you acknowledge and agree to have read, understood and agreed to the Terms and Conditions set out below.

After registration has been completed you receive your personal account data, with which you can use the functions reserved for registered users on Tripelonia.

Besides this, you provide additional information through your activities on Tripelonia, for example through adding reviews, using the community and administrative functions, as well as through your user behaviour. In addition, your correspondence with us can be stored and evaluated.

Please note that you can revoke your consent to this agreement and stop Tripelonia from storing and processing your personal data at any time.

 

2.2. How does Tripelonia use its user’s personal information?

Tripelonia makes internal analyses concerning demography, interests, and general user behavior. These analyses are based on the personal information given during registration or at later times or through server log files. We conduct such analyses in order to better understand our users and to optimize Tripelonia's services.

Whenever you share personal information with Tripelonia, the information is solely for the use of Tripelonia unless you are informed otherwise when the information is requested.

Tripelonia offers its partners the possibility to place advertisements on the platform. It is possible that these partners may use cookies in their advertisements which collect information about user behaviour.

Tripelonia does not publish any personal information that could be used to identify you, unless you have given your permission or Tripelonia is obligated to do so for legal reasons.

 

2.4. Which security measures are taken in order to protect the users' information?

The Tripelonia member account and the information therein is password-protected so that only the user has access to his/her personal information. The user can update his member profile at any time. We firmly recommend that you do not reveal your password to any third person. Tripelonia will never ask for or request your password in unsolicited emails. If you want to end your current visit to Tripelonia, remember to log out of your member account and close the browser window so that no unauthorised person can access your member profile by chance. This is especially important when you share a computer with other people.

 

2.5. Users Rights

Tripelonia users have the right to demand not to Process their Personal data for any marketing purposes. Usually, Tripelonia informs the users (prior collecting their data) if we intend to use the data for such purposes or intend to disclose your information to any third party for any other purposes.

3.  REGISTRATION & NEWSLETTER SUBSCRIPTION

You may be required to set up a Tripelonia account ("Tripelonia Account") in order to access certain features of the Services.  

  1. Tripelonia Account Information.  

If you elect to set up a Tripelonia Account, you will provide true, accurate and complete registration information and will maintain as current and promptly update relevant personal information provided to Tripelonia. You will not use false identities or impersonate any other person or use a name that you are not authorized to use.  Only one (1) Tripelonia Account is allowed per user and is for individual use only.  

To set up a Tripelonia Account and to complete your registration, choose a user ID, password, provide an email address and accept the terms and conditions. This will complete the registration process, and you will be able to use your user ID and password to access yout Tripelonia Account at any time.

Your User ID must be between 6 and 20 characters long, and can contain any combination of letters (capital or lower-case), numbers, underscores (_) or periods (.).  Your user ID is case-sensitive; please take note of the capitalization, and be sure to enter your user ID exactly the same way each time you login.  If the user ID you have chosen is already in use you will need to choose a different user ID.

Your Password must be between 6 and 20 characters long, and must be different from your user ID.  Your password is case-sensitive; please take note of the capitalization, and be sure to enter your password exactly the same way each time you login.  Please keep your password confidential.

Your Email Address is required for registration.  You must accept the Terms and Conditions in order to complete your registration. 

By default, you will receive a Registration Confirmation Email at the email address that you have provided. To complete the Account registration you will have to open and confirm the receipt of the e-mail send by Tripelonia.

  1. Security of your Tripelonia Account.  

You are responsible for safeguarding and maintaining the confidentiality of your Tripelonia Account information and agree not to disclose your password to anyone, including friends, family, and business associates. Accordingly, you shall not allow other persons access to or use of such username or password. You shall not post your username or password on any website nor transmit it through unsecured sites. If we feel your username and password are insecure or otherwise problematic, we may require you to change it and/or terminate your account.  You agree that you are entirely and solely responsible for any and all activities or actions that occur under your Tripelonia Account, whether or not you have authorized such activities or actions.  You agree to notify us immediately in the event of any unauthorized use of your Tripelonia Account or any other breach of security.  

  1. Assignment / Transfer of Your Account.

You agree not to assign, transfer or sublicense your rights as a user of the Services.

Failure to comply with the obligations in this Section may, at our option, result in immediate suspension or termination of your right to use the Services.

  1. Cancellation

Tripelonia can cancel a user's account and delete their registration within one week of notice. The user can also cancel membership with the same term of notice. The right to immediate cancellation for important reasons remains unaffected.

 

 

 

4. LIABILITY FOR CONTENT  

Neither Tripelonia nor the user is liable for the accuracy, quality, and degree of completion, reliability, or credibility of information on Tripelonia posted by users. The user uses the content of Tripelonia at his/her own risk, in particular for the choice of accommodation, travels, or other services based on the content of Tripelonia. In particular, retrieving information on Tripelonia does not represent a consulting service or advice. Content generated and published by users does not represent the opinion of Tripelonia, and Tripelonia does not adopt this content as its own. Tripelonia is also not liable for the quality, completion, reliability, or type of its editorial content. In particular, retrieval of any editorial content on Tripelonia does not represent any consulting service or recommendation. This is not valid as far as the content itself harms the rights of any third party. For such a case, legal liability is unaffected.

 

Hyperlinks, advertisement banners, business data of accommodations, tourist attractions, or providers etc. do not represent a recommendation from Tripelonia for a third party or third party services. Tripelonia is not liable for prices or availability, and Tripelonia does not adopt this particular content as its own.

 

  1. TECHNICAL LIABILITY

Tripelonia is not liable for technical malfunctions that Tripelonia is not responsible for or malfunctions that were caused by uncontrollable circumstances.

Tripelonia does not guarantee uninterrupted availability of data and can freely choose to be unavailable for a particular timeframe for maintenance.

 

  1. LIABILITY FOR COMMERCIAL OFFERS

Tripelonia is at no time the provider of any commercial services to end-users that are offered directly or indirectly on Tripelonia. Specifically, Tripelonia will at no time be the contractual partner for end-user's services. 

Offers, in particular those related to the booking of hotels and trips or services or products related to them, are based on the databases and websites of external contracting parties. Tripelonia takes no liability for the degree of completion and accuracy of these offers. There is no warranty that the deals are up-to-date. Please contact the provider of the offer if there are any problems. We do not control or have influence on those websites and we therefore do not guarantee for these external contents. Responsible for the content of the linked websites is the respective provider or operator of the third party website.

 

All contracts that arise from these offers are formed between the Tripelonia user and the particular external contracting party. In particular, Tripelonia at no time takes the role of a tour operator or travel agency. The general business and contract conditions of the particular operators or travel agencies apply, especially the rights to revoke and withdraw. The contact for the organisation of bookings and payment, as well as inquiries of any kind is always the respective partner. Tripelonia is not involved in any agreement or claim between the user of Tripelonia and the respective partner, and thus remains legally free and unaffected thereof.

 

 

7. USE OF THE SERVICES

You are responsible for your use of the Services and for any consequences thereof, including any information or materials you choose to make available, public or private communications transmitted through the Services (including posts), usernames and passwords that you provide to the Services, including those usernames and passwords provided by you for access to various third party services (e.g., social networking and other accounts that you wish to link with your account on the Services).  

You may only use the Services for lawful purposes. You acknowledge that storing, distributing or transmitting unlawful material could expose you to criminal and/or civil liability.  You may not download (other than page caching) or modify our Services or any portion of them unless we have provided you with express written consent.  You may not make a derivative use of the Services or their contents for any purpose, nor may you download or copy information of Users, or otherwise engage in data mining or similar data gathering.

 

8.  USER-SUBMITTED FEEDBACK, SUBMISSIONS, POSTINGS AND E-MAILS

Certain areas on the Services may allow you to provide us or others with photos and other images, commentaries, reviews, video, Feedback (defined below), posts, public and private messages or other potential content from you (User Materials).  The user is responsible for the content (texts, photos, ratings, links, etc.) that he/she adds on Tripelonia. The user confirms that he/she holds the legal rights of the content he/she is publishing on Tripelonia and thereby does not violate the rights of a third party. The user irrevocably grants Tripelonia the rights to publish, distribute, or alter the content that he/she added to the web site without any limitation in terms of time, space, and content, and without any claim for reimbursement by you or a third party.

The user is responsible for any regulations he/she violates and understands that it is forbidden to use Tripelonia to publish content that:

  • represents an advertisement;
  • is not related to the reviewed object;
  • contains irrelevant or intentionally incorrect information;
  • is immoral, pornographic, or otherwise offensive;
  • violates the rights of third parties, in particular copyrights;
  • otherwise violates applicable laws or constitutes a criminal act;
  • contains viruses or other computer programs that harm soft- or hardware or can affect the use of a computer in an unwanted way;
  • contains questionnaires or chain letters;
  • is aimed at collecting personal data from other users, in particular for commercial purposes;
  • assistance and/or links regarding illegally acquired software, as well as copyright violations;
  • provocations, insults, verbal abuse;
  • several user accounts for one person at the same time;
  • Partner program links, promotional and fraud links using referrers;
  • advertising for your own products or websites, personal ebay auctions or similar self-promotion;
  • Sale offers;
  • Spam.

The user furthermore represents and warrants that:

  • he/she has no more than one user account even if he/she has multiple email addresses.
  • he/she does not use programs or functions to generate content or view pages automatically.

In the case of a violation of the terms and conditions, Tripelonia has the right, without declaration of reason, to withhold payments accumulated through the Tripelonia shares program and permanently exclude users from the platform. Prosecution of criminal acts remains unaffected by this.

Specific rules or additional terms may apply to the submission of certain User Materials.  These terms will be provided in connection with those portions of the Services and, while these Terms and Conditions will apply to all User Materials, such additional terms shall supplement the Terms and Conditions unless expressly provided otherwise.  In any event, any User Materials you send to us will not be treated as confidential.

We are interested in hearing from you regarding your questions or comments about our Services.  You may provide suggestions, comments or other feedback about our Services (collectively "Feedback") by writing to support@Tripelonia.com.  We regret that we may not be able to respond to Feedback.  

 

9. OUR USE OF USER MATERIALS

While we do not claim ownership of User Materials, by providing User Materials to us or others via the Services you are automatically granting us a perpetual, irrevocable, worldwide, paid up, non-exclusive license to use the User Materials or any of its elements for any type of use forever, including promotional and advertising purposes and in any media whether now known or hereafter devised, including the creation of derivative works that may include User Materials you provide. You agree that any User Materials you provide us may be used by us and you are not entitled to any payment or other compensation for such use.

You hereby confirm:

(a) your User Materials will be not be subject to any obligation, of confidence or otherwise, to you or any other person;

(b) your posting of the content on or through the Services does not violate the privacy rights, publicity rights, copyrights or other rights of any other person; and

(c) your posting is in accordance with this Terms and Conditions and that we shall not be liable for any use or disclosure of such User Materials.  We reserve the right (but do not assume the obligation) in our sole discretion to reject, move, edit or remove any User Materials that are contributed to the Services.  You acknowledge that we do not verify, adopt, ratify, or sanction User Materials, and you agree that you must evaluate and bear all risks associated with our use of User Materials or our reliance on the accuracy, completeness, or usefulness of User Materials.

We reserve any and all exemptions from liability that may be available under the copyright or other applicable law.

 

14. ABUSE OF SERVICES

You agree not to bypass, modify, defeat or tamper with or circumvent any of the functions or protections of the Services, or content or mechanisms that protect or limit use or access to the Services or content, including, but not limited to, any digital rights management functionality.  You agree that you will not compromise security of the Services, content and/or Tripelonia Accounts or tamper with system resources.  Also, decompiling, reverse engineering, disassembling, or otherwise using technical means to investigate and/or replicate the functionality of the Services and/or to copy or create other products based (in whole or in part) on the Services, is prohibited. If you become involved in any violation of system security, we reserve the right to release your details to system administrators at other sites and to law enforcement agencies in order to assist them in resolving security incidents.

If a dispute arises between you and us, our preference is to resolve the matter quickly and in the most cost effective manner possible.  Before resorting to the methods described below for settling a dispute, we ask that you provide us with notice of the dispute via email to support@Tripelonia.com.

The Romanian courts shall have exclusive jurisdiction and venue over any dispute arising out of or relating to this Agreement.

 

19.  MISCELLANEOUS

If any provision of these Terms and Conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable for this agreement and shall not affect the validity and enforceability of any remaining provisions.

Headings and captions are used herein for convenience only and shall not be used to interpret these Terms and Conditions.

 

20.  CONTACT INFORMATION
